Terms of Service

BookdHUB ("BookdHUB," "we," "us," or "our") operates a scheduling platform that allows service providers ("Providers") to publish services and allows customers ("Customers") to book and pay for time slots (collectively, the "Services").

By creating an account, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Services. You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account.

BookdHUB is a technology platform that facilitates connections between Providers and Customers. BookdHUB is not a party to any agreement between a Provider and a Customer and does not itself provide, supervise, or control the underlying services offered by Providers.

• You are responsible for the accuracy and completeness of the information you provide, and for promptly updating it if it changes.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether or not authorized by you. Notify us immediately at support@bookdhub.com of any unauthorized use.
• Providers are solely responsible for the accuracy of their service listings, the qualifications required to perform listed services, and the fulfillment of bookings they accept.
• We reserve the right to suspend or terminate any account that provides false, misleading, or incomplete information, or that we reasonably believe poses a risk to the platform, other users, or third parties.
• One account per person. Accounts may not be shared, sold, or transferred without our prior written consent.

Payments for services booked through the platform are processed by our third-party payment processor, Stripe. By making a payment, you agree to Stripe's terms of service and privacy policy, in addition to these Terms. BookdHUB does not store your full payment card information.

All applicable fees, including any BookdHUB service fees, are disclosed prior to checkout. You authorize us (or Stripe, on our behalf) to charge your selected payment method for all amounts due.

Cancellation and refund policies are set by the individual Provider for each listing and are disclosed at or before booking. BookdHUB is not responsible for issuing refunds on a Provider's behalf, except where required by applicable law or where BookdHUB service fees are involved.

Disputes regarding the quality or performance of a service should be directed to the Provider in the first instance. BookdHUB may, at its sole discretion, assist in resolving disputes but is under no obligation to mediate, refund, or otherwise intervene.

You are responsible for any taxes applicable to your use of the Services, other than taxes on BookdHUB's net income.

By opting in during registration, you consent to receive recurring automated account-related text messages from BookdHUB at the mobile number you provide, including booking confirmations and appointment reminders.

• Consent is not a condition of purchase.
• Message frequency varies (typically up to 6 messages per month).
• Message and data rates may apply.
• To opt in: reply START, YES, or UNSTOP to confirm or resume messages (you can also opt in during registration).
• To opt out: reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT at any time to cancel. After you send an opt-out keyword, we will send one confirmation message and then stop sending messages.
• For help: reply HELP or INFO, or contact support@bookdhub.com.
• These keywords are not case-sensitive.
• We do not sell, rent, or share your mobile phone number or SMS opt-in status with third parties for their own purposes. Your number is used solely to deliver the messages described in this Section and related account communications, consistent with our Privacy Policy.
• Carriers are not liable for delayed or undelivered messages.

Supported carriers are not liable for undelivered or delayed messages. You are responsible for notifying us of any change to your mobile number.

You agree not to:

• Misuse the platform, interfere with or disrupt its operation, or attempt to gain unauthorized access to any systems or networks connected to the Services;
• Use the Services for any unlawful, fraudulent, deceptive, or harmful purpose;
• Post or transmit false, misleading, defamatory, obscene, or infringing content;
• Circumvent or attempt to circumvent any fees owed to BookdHUB by arranging payment outside the platform for a booking initiated through it;
• Scrape, harvest, or collect data from the platform using automated means without our prior written consent;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Use the Services to harass, threaten, or harm another user.

We reserve the right to investigate suspected violations and to suspend or terminate accounts, remove content, or take other appropriate action, with or without notice.

Providers represent and warrant that they:

• Hold all licenses, permits, insurance, and qualifications legally required to perform the services they list;
• Will perform booked services with reasonable care and skill and in compliance with applicable law;
• Are solely responsible for their interactions, and any disputes, with Customers arising from bookings;
• Will not use the platform to list services that are illegal, unsafe, or that violate these Terms.

BookdHUB does not verify Provider credentials, licenses, or insurance unless expressly stated otherwise for a given listing, and makes no representation as to the quality, safety, or legality of services offered by Providers.

The Services, including all software, text, graphics, logos, and other content provided by BookdHUB (excluding Provider- and Customer-generated content), are owned by BookdHUB or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.

By posting content (such as listings, reviews, or profile information), you grant BookdHUB a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute that content in connection with operating and promoting the Services.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. BOOKDHUB DOES NOT WARRANT THE QUALITY, SAFETY, LEGALITY, OR RELIABILITY OF ANY SERVICE LISTED OR BOOKED THROUGH THE PLATFORM.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOOKDHUB AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BOOKDHUB'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT OF FEES YOU PAID TO BOOKDHUB IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless BookdHUB and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; or (d), for Providers, the services you list or perform.

You may stop using the Services and close your account at any time. We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for violation of these Terms. Sections of these Terms that by their nature should survive termination (including Sections 7–13) will survive.

These Terms are governed by the laws of the State of [Insert State], without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved informally by contacting support@bookdhub.com. If a dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration on an individual basis, in accordance with the rules of [Insert Arbitration Body, e.g., the American Arbitration Association], except that either party may bring an individual action in small claims court. You and BookdHUB each waive any right to a jury trial or to participate in a class action.

• Changes to These Terms: We may modify these Terms from time to time. We will post the updated Terms with a new "Last Updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
• Force Majeure: BookdHUB is not liable for any failure or delay in performance resulting from causes beyond its reasonable control.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
• No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
• Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BookdHUB regarding the Services.
